Terms of Use

These conditions govern use of Berrien County Criminal History. Visiting a page, reading content, or submitting a search means you accept them. If you disagree, stop using the service.

NO FCRA USE. This privately operated website has no government affiliation. Neither it nor its advertising partners offers a service for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act. The site identifies Berrien County, Michigan record sources. It is not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site with no government connection. It does not store official records, retrieve files, conduct official checks, or submit documents for a visitor.

Its role is to identify Berrien County custodians, including the Sheriff's Records Division, Trial Court, Michigan State Police CJIC, and Michigan Public Sex Offender Registry, and to provide access to outside research tools.

2. Rules for Using This Site

You agree that you will not:

  • Run a bot, scraper, or other automated collection tool against the pages
  • Threaten, stalk, intimidate, or harass anyone with information found here
  • Attempt to enter a system or area without authorization
  • Use the content for a housing, employment, credit, or insurance decision
  • Disrupt the service or interfere with another visitor's access
  • Violate federal, Michigan, or local law

3. No Harassment, Stalking, or Discrimination

Information from this site or a linked tool may not be used to stalk, threaten, intimidate, harass, or unlawfully discriminate. Michigan law, including MCL 28.730, restricts misuse of Michigan PSOR data and may provide penalties or civil remedies. Registry publication supports safety awareness, not vigilantism.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA. No consumer report, credit report, or official background check is created here. The site and its advertising partners do not offer services designed for FCRA-regulated decisions. Data from these pages or linked tools may not be used to:

  • Assess creditworthiness or determine an insurance premium
  • Evaluate an employee or job applicant
  • Screen a renter or housing applicant
  • Determine access to a government program, permit, or license
  • Make any other decision governed by the FCRA

A check needed for a regulated purpose must come from the proper Michigan State Police channel or a qualified FCRA-compliant provider.

5. No Legal Advice

Nothing here is legal advice. General Berrien County record information cannot determine how a charge, conviction, warrant, or set-aside law applies to one case. Consult a licensed Michigan attorney.

6. No Warranties

The site is provided "as is," without a guarantee that:

  • An outside provider's results will be complete or correct
  • Information will always be accurate, current, and complete
  • Every page will be free of defects or security flaws
  • The service will remain available without interruption

Records change as charges are filed or dismissed, material is sealed, and convictions are set aside. Delays and gaps can occur. No site content is an official statement from a court, sheriff, or agency.

7. Third-Party Services and Links

Links may lead to sheriff pages, court portals, Michigan agencies, legal resources, or outside search providers. The destination is beyond our control. We are not responsible for its content, availability, privacy practices, or price. Read that service's terms before using it.

8. Intellectual Property

Text, graphics, logos, and code belong to Berrien County Criminal History or its content partners. Written permission is required to copy, distribute, alter, or build upon that material.

9. Limits on Our Liability

To the fullest extent permitted by law, we are not liable for damage arising from use of the site, reliance on its content, or use of a linked service.

10. Indemnification

You agree to defend and hold us harmless from a claim or demand caused by your site use or breach of these terms, including related costs and reasonable legal fees.

11. Governing Law

Michigan law governs these terms. A dispute tied to site use must be filed in an appropriate Michigan court. Michigan FOIA, MCL 15.231 et seq., governs access to qualifying public-body records, while MCL 28.243 governs state criminal-history reporting and maintenance. Those laws regulate official custodians, not this private site.

12. Changes to These Terms

We may revise these terms. The new version takes effect when posted on this page.

13. Cutting Off Access

Access may be restricted or ended at any time, with or without advance notice.

14. Severability

If one provision is held invalid or unenforceable, all remaining provisions continue. The affected term will be narrowed only as much as necessary.

15. Questions

Questions about these terms may be submitted through the Contact page.
